JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 29-04-2015 The petitioner has renewed his prayer for anticipatory bail in connection with Patory P.S. Case No. 211 of 2012 registered for the offences punishable under Sections 341, 324, 307/34 of the Indian Penal Code and 27 of the Arms Act, pending in the court of learned Chief Judicial Magistrate, Samastipur.

The accusation is of causing injury with pistol on the chest of the informant.

The earlier anticipatory bail application of the petitioner was disposed of vide Cr. Misc. No. 48141 of 2012 with liberty to the learned court below to consider the prayer for bail of the petitioner, if the petitioner surrenders before the learned

Patna High Court Cr.Misc. No.14327 of 2015 (02) dt.29-04-2015 2/2 court below within a period of six weeks. The prayer for anticipatory bail has also been dismissed by the Apex Court vide Special Leave to Appeal (Cri) No. 2331 of 2013. It is submitted by learned senior counsel for the petitioner that the injury has been found to be simple and there is no repetition of blow.

Let the learned court below consider the prayer for regular bail of the petitioner, if he surrenders before the learned court below within a period of four weeks from today without being prejudiced by the order of this Court. Accordingly, this application is disposed of.
