The petitioner seeks bail in connection with Barhara P.S. Case No. 04 of 2017, registered under Section 302 and 120(B)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of petitioner surfaced in the confessional statement of co-accused Amit Kumar, except the confessional statement no tangible material has been collected against the petitioner. Further submission is that petitioner has no criminal antecedent is in custody since 06.04.2017.

No.23496 of 2017 (3) dt.28-06-2017 2/2 Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-II, Purnea in connection with Barhara P.S. Case No.04 of 2017. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
