This is an application for regular bail in connection with Thakurganj P. S. Case No. 115 of 2017 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
Informant is brother of deceased who in his written complaint has stated that his deceased sister was married to one Kisan Mahto eight years ago but relation with her husband was not cordial. His sister used to live separately with her two children. She used to earn her livelihood from her employment in Kolkatia Tea Garden. On 27.10.2017 she left house for her job but thereafter she did not return. Even after much search she could not be traced. On 31.10.2017 informant received information that one female dead body is lying near the Tea
Patna High Court Cr.Misc. No.15783 of 2018(2) dt.12-04-2018 2/2 Garden and it was of his deceased sister in a mutilated condition. FIR has been lodged against unknown. Name of petitioner has surfaced on the basis of talk between deceased and petitioner and thereafter on the basis of his confession made before the police and except these materials there is no other incriminating materials against petitioner. Petitioner has no criminal antecedent and is in custody since 14.11.2017. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned CJM, Kishanganj, in connection with Thakurganj P. S. Case No. 115 of 2017.
