2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 103(1), 61(2), 54 and 351(3) of the B.N.S.
3. The case of the prosecution is that the father of the informant was getting shaved in a salon, at that time seven named persons arrived and they fired at him due to which he died. In the FIR it is also alleged that there were certain unknown persons as well who have covered their face. By CCTV footage certain persons were identified and the petitioner is one of them.
4. Learned counsel for the petitioner has submitted that the only allegation against this petitioner is that he was identified in the CCTV footage. There is no specific allegation
Patna High Court CR. MISC. No.15604 of 2025(2) dt.04-04-2025 2/2 against the petitioner neither there is allegation of conspiracy against this petitioner. The petitioner is a man of clean antecedent and he is in judicial custody since 20.08.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bangaon P.S. Case No. 106 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned court of Judicial Magistrate, 1st Class, Saharsa.
