JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 27-08-2015 The petitioner seeks a direction to the respondent- Power Grid Corporation not to extend their High Tension wire above the residential land bearing Khata No. 19, Khesra No. 416 measuring an area of 11.50 decimals and Khata No. 53, Khesra No. 416 measuring an area of 6 decimals , total area of 17.50 decimals. The petitioner has not made any statement in the pleading as to the Mouza over which the plot is situated. However, one gets the detailed reference from annexures.

According to the petitioner he has purchased the aforesaid land on 8.3.2011 from one Ranjan Kumar son of Sidheshwar

The petitioner states that a high transmission tower is erected just 100 meters away from the land of the petitioner and the High Tension electric wire passes through the above land. The petitioner seeks to change the route of High Tension wire, otherwise residential purpose would be unfit for occupation. Learned counsel for the petitioner submits that the petitioner has no other land for residential purpose.

Counsel for the Power Grid Corporation prays for time to file counter affidavit in the matter. He submits that the petitioner has purchased the land after the route of High Tension wire was finalized.

I find that the petitioner has already filed a representation on 18.01.2015 before the District Magistrate, Nalanda. In that view of the matter, the District Magistrate, Nalanda is directed to dispose of the representation of the petitioner within a period of four weeks from the date of receipt/production of a copy of this order. The District Magistrate, Nalanda, will also give a personal hearing to the petitioner. The writ petition is disposed of.
