The application, as prayed, is dismissed in so far as petitioner nos. 1 (Indrajit Singh) and 3 (Daroga Singh) are concerned as they have been arrested.

Rest three accused persons seek bail in Garkha P.S. Case No. 17 of 2016 registered under Sections 147, 341, 323, 324, 307 and 504 of Indian Penal Code.

On going through the F.I.R., it appears co-accuseds Sujit Singh and Indrajit Singh started assaulting the informant. Family members of the informant came to rescue him when Saheb Singh assaulted Chandeshwar Sah and Sujeet singh is said to have assaulted Arun Sah causing some injury. Petitioner nos. 4

Patna High Court Cr.Misc. No.11087 of 2016 (3) dt.23-05-2016 2/2 and 5 are said to be order giver. Injury sustained by Urmila Devi and Renu Devi are said to be trivial in nature. Petitioners claim no murky past.

Considering the above, in the event of arrest or surrender in the Court below within four weeks, the petitioner nos. 2, 4 and 5 are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Saran at Chapra in Garakha P.S. Case No. 17 of 2016 subject to the condition as laid down under Section 438(2) of the Cr.P.C. with the further following conditions: (i) One of the bailers shall be the own/close family members of the petitioners.

(ii) In case of framing of charge, the petitioners shall appear in person on each and every date fixed in the Court below. In case of default in doing so on two consecutive occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioners and secure their arrest in accordance with law.
