The petitioners seek bail in Sakra P.S. Case No.31 of 2007 registered under Section 420, 467, 468, 471, 120B, 504, 379/349 of the Indian Penal Code.
As per the prosecution case, the petitioners are said to have got executed four sale deeds from the mentally retired cousin brother of the informant, namely, Sujay Shankar Thakur without payment of any sale consideration.
It is submitted by learned counsel for the petitioners that the aforesaid Sujay Shankar Thakur has executed the sale deeds in favour of the petitioners after obtaining the sale consideration of the same and appearing before the Sub-Registrar, Sakra and accepting the execution of the same. Moreover, it is a
Patna High Court Cr.Misc. No.7404 of 2018 (02) dt.07-02-2018 - 2 - pure civil nature case and the informant has filed false case against the petitioners to mount pressure upon them to extract money from them. Final form against the petitioners has been submitted by the police but the learned Magistrate has taken cognizance against them. The petitioners have been languishing in custody since 25.11.2017.
In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-cum-Sub Judge 13th, Muzaffarpur in connection with Sakra P.S.
