====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------ 22-08-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in connection with Panjwara P.S. Case No.04 of 2016 registered under Sections 395 and 397 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that it would appear from the F.I.R. that on the basis of the written report of the informant Banwari Mandal, the present case was lodged under Sections 395 and 397 of the Indian Penal Code against 6-7 unknown. In course of investigation, one Niranjan Yadav alias Niro Yadav was apprehended by the police,

Patna High Court Cr.Misc. No.27986 of 2017 (4) dt.22-08-2017 2/2 who confessed his guilt having hand in the present case, detailing the name of others including the petitioners. Except that, no material has been collected the Investigating Officer against the petitioners during investigation. The petitioners have been remanded in the present case on 15.04.2017 and since then, they are in custody. While the informant has detailed about the physique of the three culprits in the F.I.R. but the petitioners have not been put on T.I. Parade till date.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Panjwara P.S. Case No.04 of 2016. Out of the two sureties, one must be close relative of the petitioners, who will file an affidavit giving genealogy as to how he/she is related with the petitioners. The bailors will undertake to furnish information to the court about any change in the address of the petitioners. (Rajendra Kumar Mishra, J) P.S./- U T
