The petitioner apprehends his arrest in connection with Hathauri P.S. Case No. 70 of 2021 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Petitioner has criminal antecedent of similar nature and he has been named in the self-inculpatory statement of the co-accused.

In view of the allegations levelled against the petitioner, this anticipatory bail application is not maintainable in view of the judgment of the Full Bench of this Court in the

Patna High Court CR. MISC. No.13839 of 2022(2) dt.08-04-2022 2/2 case of Ram Binay Yadav Vs. The State of Bihar reported in [2019 (2) PLJR 1089 (Full Bench)]. Accordingly, it is dismissed as not maintainable.
