Petitioner, already in custody, seeks bail in connection with Dinara P.S. Case No.283 of 2017, corresponding to N.D.P.S. Case No.22 of 2017, registered under Sections 21, 22 and 23 of the N.D.P.S. Act.
Allegation in brief is that the police apprehended some persons while they were smoking smack in a hut and 14 purias of heroin in total 4 gms. is said to be recovered from possession of the petitioner.
Learned counsel for the petitioner submits that Saddam Hussain from whose possession 38 gms. heroin was recovered and another co-accused have been admitted to bail by coordinate Benches of this Court, the alleged recovery from
Patna High Court Cr.Misc. No.8608 of 2018(2) dt.13-02-2018 2/2 possession of the petitioner is 4 gms. and the petitioner has no criminal antecedent.
Having considered the said facts and circumstances, petitioner Rustam Ray @ Kuku is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional District & Sessions Judge, Rohtas at Sasaram in connection with Dinara P.S. Case No.283 of 2017, corresponding to N.D.P.S. Case No.22 of 2017 subject to the condition that the petitioner shall remain present before the trial court on each and every date as and when required and if he absents himself on two consecutive dates without any reasonable ground, his bail bond shall liable to be cancelled.
