JUSTICE ARUN KUMAR ORAL ORDER 17-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 7.3.2018, seeks bail in Madhubani Town PS Case No. 70 of 2018 registered under Sections 392 of the IPC.

The allegation in brief is that while the informant was keeping his jewelry in the dickey of his motorcycle one miscreant came on motorcycle, snatched the jewelry kept in the dickey and tried to escape away but on chase by the informant and local people he fell down from the motorcycle but he escaped away and later on apprehended on the basis of identification of the motorcycle and Adhar Card of the petitioner kept in the dickey and the jewelry was also seized.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he was not apprehended on the spot.

Learned Counsel for the State submits that he robbed the jewelry of the informant, fell down from the motorcycle and escaped away.

Having considered the aforesaid facts and circumstances, the

Patna High Court Cr.Misc. No.22487 of 2018 (2) dt.17-04-2018 prayer for bail of the petitioner is rejected. The trial court is directed to expedite the trial and preferably conclude the same within a period of nine months. (Arun Kumar, J) Snkumar/- U T
