The petitioner apprehends his arrest in Bihariganj P.S. Case No. 169 of 2014, registered for the offences punishable under Section 353 and other Sections of the Indian Penal Code. The informant alleged that a woman died in the hospital thereafter her relatives and others damage the property of the hospital and pelted stones on the police personnel. Learned counsel for the petitioner submits that the petitioner is of course named in the FIR, but no specific allegation is made against the petitioner. The petitioner is a neighbour and he was only watching the occurrence, but his name has been included in the FIR.
Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a
Patna High Court Cr.Misc. No.8887 of 2015 (2) dt.04-03-2015 2/2 period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Bihariganj P.S. Case No. 169 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
