Petitioner, in the present case, is seeking regular bail in connection with Ahiyapur P.S. Case No. 281 of 2017, registered for the offences punishable under Sections 147, 148, 149, 186, 283, 447, 341, 323, 307, 332, 333, 353, 435, 427, 504, 506 and 120B of the Indian Penal Code.
Learned counsel for the petitioner refers the First Information Report and submits that in the nature of the allegations no specific overt act has been alleged against the petitioner. There are general and omnibus allegations, the petitioner has no criminal antecedent and he had gone there only for the purpose of medical check up.
Patna High Court Cr.Misc. No.28552 of 2017 (2) dt.07-07-2017 Considering the nature of allegations particularly that there is no specific allegation against the petitioner either of committing assault or damaging the property, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 281 of 2017, subject to condition, as laid down under Seciton 437(3) of the Cr.P.C.
