JUSTICE SHIVAJI PANDEY ORAL ORDER 11-06-2020 Heard learned counsel for the petitioner and learned counsel for the State through virtual court proceeding. In this case, the petitioner is apprehending his arrest in connection with Nayagaon P.S. Case No. 147 of 2019 registered for offences under sections 188, 272, 273, 414 of the Indian Penal Code and Section 30(A), 38 of the Bihar Prohibition and Excise Act, 2016.

As per allegation, the police has recovered 70 litres country made wine from the motorcycle. The police has also arrested one person at the spot who disclosed the name of the present petitioner along with other co-accused who fled away from there.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent.

Patna High Court CR. MISC. No.12037 of 2020(2) dt.11-06-2020 2/2 Looking to the quantity of liquor recovered, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner, above name, is rejected.

If the petitioner surrenders before the court below within a period of four weeks from today and prays for bail, the court below, without being prejudiced by this order, will take a decision in accordance with law.
