NILU AGRAWAL ORAL ORDER 02-08-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. Petitioner seeks bail in connection with Puraini P.S. Case No. 61/2016 for offences punishable under Section 307 and other allied Sections of the Indian Penal Code. The prosecution case, as lodged by the informant, is that due to some petty dispute between the two brothers Md. Firoz and Md. Azad, the petitioner inflicted Dabia blow on Md. Firoz and the informant.
It has been submitted by the learned counsel for the petitioner that petitioner is the nephew of the informant and due to minor dispute fight took place between both the parties in which both parties received injuries. He submits that the injury caused by

No.28528 of 2017 (3) dt.02-08-2017 2/2 the petitioner on two persons have been found to be simple, except one on the informant, which is found to be grievous, but not on the vital part of the body. He further submits that charge-sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence.
However, learned counsel for the informant and learned APP for the State oppose the prayer for bail stating therein that the petitioner had caused injury on his own uncles. Be that as it may, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Udakishunganj, Madhepura, in connection with Puraini P.S. Case No. 61/2016.
