JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-03-2020 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Jandaha P.S. Case No. 266 of 2019 for the offence under Sections 341, 323, 448, 325, 307, 504, 506, 379/34 of the Indian Penal Code and Section 25(1-b) a, 26, 27, 36 of the Arms Act. Allegation against the petitioner is that he used firearm. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. Referring to injury report, as contained in Annexure-2, learned counsel for the petitioner submits that the injury report falsifies the allegation of firing, as the injury caused, as per the opinion of the doctor, is caused by hard and blunt substance and there is no fire-arm injury.

Considering the aforesaid, the petitioner named

Patna High Court CR. MISC. No.11949 of 2020(2) dt.05-03-2020 2/2 above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 266 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
