The petitioner has prayed for regular bail in a case instituted for the offence under Sections 328 and 414 of the IPC and Section 21(b) of the N.D.P.S. Act.
As per prosecution case, there has been recovery of 8 tablets of Ativan (2mg), Rs. 1510/- and other materials from the jacket of the petitioner. Thereafter, on asking regarding the recovered articles from the accused persons, they stated that the same has been taken from Kamlesh Kumar Pandey, after administering him this medicine.
It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to old
Patna High Court CR. MISC. No.14915 of 2023(2) dt.09-05-2023 2/2 enmity. He has committed no offence. He submitted that the petitioner has no concern with the seized articles. On the instigation of local enemies on extraneous consideration, the petitioner has implicated in the present case by the police party. He is languishing in judicial custody since 28.11.2022. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Lakhisarai in connection with Kiul Rail (G.R.P.) P.S. Case No. 149 of 2022.
