The petitioner apprehends his arrest in Brahnapura P.S. Case no. 259 of 2014, registered for the offences punishable under Section 366 and other Sections of the Indian Penal Code. The informant alleged that her daughter had gone for treatment of her father-in-law and mother-in-law, but Vicky Kumar Sahni and his friend Arun Kumar (the petitioner) enticed his daughter.
It is submitted that father-in-law of the victim filed informatory petitioner on 21.11.2014 alleging therein that his daughter-in-law had illicit relation with someone and she fled away with that one. The petitioner and the victim have already
Patna High Court Cr.Misc. No.8422 of 2015 (3) dt.04-05-2015 2/2 been recovered. The victim also made statement under Section 164 of the Cr.P.C. Victim is a major girl and she disclosed that Vickey Kumar Sahni forcibly took her to somewhere else and the petitioner helped him.
Considering the aforesaid facts that the victim is a major, petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Brahnapura P.S. Case No. 259 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
