Learned counsel for the petitioner submits that this Court should direct respondent-authorities to grant the petitioner benefit of Assured Career Progression/Modified Assured Career Progression since the same has been granted to other similarly situated as the petitioner including Shri Subhash Chandra Jha by counting the services earlier rendered by him in State Institute

Patna High Court CWJC No.4860 of 2016(2) dt.20-06-2019 2/2 of Education Technology prior to its dissolution. For the said benefit, petitioner has approached respondent No 3 by making his representations which are contained in Annexure 5 series.

Petitioner's counsel submits that though benefits have been extended to other including Shri Subhash Chandra Jha under the order of the Higher Education Department dated 15.05.2018 (Annexure 11 to the supplementary counter affidavit), the same benefit has not been extended to the petitioner.

Writ petition is, therefore, disposed of with a direction to respondent No 3 to take final decision and if the petitioner's claim is similar to that of Subhash Chandra Jha, needless to say, the petitioner will be extended the same benefits by respondentauthorities. Let final decision be taken by respondent No 3 within a period of eight weeks from the date of receipt/production of a copy of this order.
