NILU AGRAWAL ORAL ORDER 12-03-2019 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel appearing on behalf of the Bihar State Road Transport Corporation (hereinafter referred to as 'the Corporation').

Petitioner retired from the post of Traffic Clerk w.e.f. 31.01.2018 and seeks payment of his post retiral benefits including provident fund, earned leave, gratuity along with penal interest. Petitioner has filed a representation before the Administrator of the Corporation and also sent a legal notice which is Annexures-1 and 2 of the writ application but all his efforts have gone unheeded.

Considering the nature of claim as made by the

Patna High Court CWJC No.4654 of 2019(2) dt.12-03-2019 2/2 petitioner, let the petitioner file a detailed representation before the respondent no. 2, the Administrator, Bihar State Road Transport Corporation, Pariwahan Bhawan, Birchand Patel Path, Patna which will be disposed of within a period of three months from the date of filing of such representation. Any amount due to the petitioner would be paid within two months thereafter. If certain amounts are inadmissible, the same shall be communicated to the petitioner by a speaking order sent through registered post.

Writ application is disposed of accordingly.
