The petitioner is languishing in custody for the offences punishable under Sections 379/413/414/120B/34 of the Indian Penal Code.
The FIR of the theft of motorcycle is against unknown.
Submission is that the petitioner is in custody since 08.11.2017. However, he was never put on Test Identification Parade nor anything has been recovered from his possession. Petitioner was simply remanded from some other case on the basis of confessional statement of co-accused. The investigation is complete and the petitioner is ready to cooperate
Patna High Court Cr.Misc. No.18710 of 2018 (2) dt.04-04-2018 P2/ with the trial.
Considering the aforesaid submission, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with K. Hat P.S. Case No.469 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
