JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 17-05-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Durgawati P.S. Case No. 18 of 2023. registered for the offences punishable under Sections 419 and 420 of the Indian Penal Code and Sections 30(a), 32, 41(I) (II) of Bihar Prohibition and Excise Amendment Act 2022.

As per allegation, the petitioner is driver of a truck wherefrom 3533.40 liters of liquor was recovered. The learned counsel for the petitioner has submitted that he is innocent and has falsely been implicated in this case. He is merely driver and was not aware of the consignment loaded in that truck. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cum Special Judge, Excise-II, Kaimur at Bhabhua/ concerned court in connection with Durgawati P.S. Case No. 18 of 2023, subject to the following conditions:- (i) Before accepting the bail bond of the petitioner, his criminal antecedent shall be verified from his home district Aligarh, Uttar Pradesh within a period of one month.
