JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Patahi P.S. Case No. 167 of 2015 for the offences instituted under Sections 366(A) and 504/34 of the Indian Penal Code.

As per prosecution case, the informant's sister, namely, Shilpi Kumari went to appear in her half yearly examination of Class-IX on 12.10.2015 in the Shyam Sundar Pathak High School Bakhari but till evening she did not return at her home and started to search her in their relatives and in course of search the informant went to her sasural where he came to know that coaccused Ranvir Chaudhary @ Nanhak Chaudhary with the cooperation of his elder brother of petitioner no.1 and also threatened

Patna High Court Cr.Misc. No.10971 of 2016 (2) dt.25-04-2016 to kill the informant and family members.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The main allegation is against co-accused Ranvir Chaudhary @ Nanhak Chaudhary. Petitioner no.1 is the elder brother and petitioner no.2 is the mother of said Ranvir Chaudhary @ Nanhak Chaudhary with whom the daughter of the informant has eloped. There is no specific allegation made against the petitioners. On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Patahi P.S. Case No. 167 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, East Champaran at Motihari, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
