Petitioner, already in custody, seeks bail in connection with Gaurichak P.S. Case No.299 of 2016, registered under Sections 363, 366 and 366(A) of the Indian Penal Code. Allegation in brief is that the informant's minor daughter was kidnapped by the petitioner and raped her during the period of confinement.

Learned counsel for the petitioner submits that it was a case of elopement.

Learned counsel for the State submits that the girl was recovered and her statement was recorded under Section 164 Cr.P.C. in which she stated that she was raped in confinement and her age was assessed 14 years.

Patna High Court Cr.Misc. No.9646 of 2018(3) dt.19-02-2018 2/2 Having considered the said facts and circumstances, the prayer of bail of the petitioner is rejected in connection with Gaurichak P.S. Case No.299 of 2016, pending in the court of learned A.C.J.M.-III, Patna City.
