The petitioner seeks bail in a case registered under Section 392 of the Indian Penal Code.

Allegation is that four unknown miscreants took away Rs.8000/- and one mobile cell phone of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.12.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on self confession of the petitioner made under Section 161 of Cr.P.C. Same has no evidentiary value.

Patna High Court CR. MISC. No.11535 of 2020(2) dt.28-02-2020 2/2 There is no recovery of any incriminating article from the possession of the petitioner. The petitioner has not been put on T.I.P.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Arrah in connection with Tarari P.S. case No.104 of 2019.
