The petitioner apprehends her arrest in Hilsa P.S. Case No. 64 of 2016 registered for the offences punishable under Sections 366(A) and 34 of the Indian Penal Code. The informant alleged that while he had gone for irrigation of his land, Lakshman Kumar @ Lakshman Yadav came and enquired about Paro Devi from the wife of the informant at his home. Lakshman Kumar @ Lakshman Yadav requested the wife of the informant to allow Paro Devi to go along with him as his sister-in-law Tetari Devi, the petitioner wanted to see her. The wife of the informant allowed Paro Devi to go along with Lakshman Kumar @ Lakshman Yadav but her daughter did not return.
Patna High Court Cr.Misc. No.25050 of 2016 (4) dt.21-09-2016 2/2 Learned counsel for the petitioner submits that the petitioner did not call Paro Devi. The victim had gone along with Lakshman Kumar @ Lakshman Yadav. Lakshman Kumar @ Lakshman Yadav and Ashok Yadav have already been granted anticipatory bail by a coordinate Bench of this Court vide order passed in Cr. Misc. No. 26397 of 2016 on 11.07.2016.
Considering the facts aforesaid and the fact that the person Lakshman Kumar @ Lakshman Yadav who took Paro Devi on the pretext of meeting with the petitioner and Ashok Yadav have already been granted anticipatory bail, the petitioner above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, II, Hilsa, Nalanda in Hilsa P.S. Case No. 64 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.)
