KUMAR ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 395 and 412/34 of the Indian Penal Code. It has been submitted on behalf of petitioner that according to the driver of the truck, he was driving the truck loaded with inverters and on the way 8 to 10 persons looted the truck with articles. It is further submitted that petitioner has got no criminal antecedent. He has falsely been implicated in the present case because of enmity. Petitioner is not named in the F.I.R. and his name has come on the basis of confessional statement of the co-accused. No recovery has been made from the possession of the petitioner. He is in jail custody since 16.05.2017. It is also submitted that similarly situated co-accused

Patna High Court Cr.Misc. No.29620 of 2017 (2) dt.06-07-2017 2/2 persons have been granted bail by different Benches of this Court, which are Annexure-3 series to the petition.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-II, Naugachia, in connection with Naugachia P.S. Case no. 07 of 2014, G. R. no. 60 of 2014.
