The petitioner has been in custody since 22.10.2017 in connection with Fatehpur P.S. Case No. 371 of 2017 for the offence registered under Sections 302, 201, 120(B) and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is said to be one of the six accused persons who are alleged to have assaulted the deceased and after killing him had thrown the body in the well.
Diary of the present case was called for which has since been received.
Learned counsel for the State after perusal of the case diary submits that though the body was recovered from the well, no external injury is said to have been found on the person of the deceased and, as such, entire case comes under the cloud.
Patna High Court Cr.Misc. No.8121 of 2018 (3) dt.05-03-2018 Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-Xth, Gaya in connection with Fatehpur P.S. Case No. 371 of 2017.
