02. In the present case, the petitioner seeks bail in connection with Begusarai Town P.S. Case No. 376 of 2024 registered for the alleged offences under Sections 126(2), 115(2), 117(2), 109, 352, 351(2), 3(5) of BNS.

03. As per prosecution case, the petitioner and his coaccused brother has been abusing the informant and when the informant objected, the petitioner threw a brick on her. Thereafter, the petitioner assaulted 2 1/2 years old daughter of the informant with iron rod on her head causing fracture. From the brick thrown by co-accused, the husband of the informant

Patna High Court CR. MISC. No.14397 of 2026(4) dt.24-06-2026 2/3 received injury on his finger. The father of the informant was also assaulted by other co-accused persons.

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. There is case and counter case between the parties and petitioner side has filed Begusarai Town P.S. Case No. 404 of 2024 for the offences under Sections 126(2), 115(2), 117(2), 109, 329, 74, 3(5) of BNS against the informant side. Learned counsel further submits that there has been long standing dispute between the parties and for this reason, the prosecution side has filed a number of cases against the petitioner. The petitioner is having antecedent of four cases and he is on bail in two cases. The petitioner is in custody since 03.09.2025 and charge sheet has been submitted.

05. Learned APP opposes the submission made on behalf of the petitioner. Learned APP submits that the petitioner is stated to have assaulted a girl child aged about 2 1/2 years causing injury to her.

06. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the case and counter case between the parties and further considering the period of custody of the petitioner and

No.14397 of 2026(4) dt.24-06-2026 3/3 submission of charge sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai/concerned Court in connection with Begusarai Town P.S. Case No. 376 of 2024, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions :

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
