JUSTICE ARUN KUMAR ORAL ORDER 15-06-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Begusarai Muffasil P.S. Case No.492 of 2016 registered under Sections 399, 402, 414 of the Indian Penal Code, Sections 25(1-b)A, 26, 35 Arms Act and Sections 30(a)/37(b) of the Bihar Prohibition and Excise Act, 2016..
Allegation in brief is that large number of miscreants had assembled at an orchard and making a plan to commit dacoity. In the meantime, the police reached there and apprehended and recovered fire arms and liquor from the accused persons and from the petitioner, two live cartridges were recovered from his pocket. Learned counsel appearing on behalf of the petitioner
Patna High Court Cr.Misc. No.23970 of 2017 (2) dt.15-06-2017 2/2 submits that only two live cartridges were recovered, not fire arm and similarly situated co-accused has been granted bail by the learned court below itself and the petitioner has been in custody since 5.12.2016.
Having considered the said facts and circumstances, the petitioner, namely, Ram Nandan Paswan @ Doman Paswan is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Begusarai in connection with Begusarai Muffasil P.S. Case No.492 of 2016.
