JUSTICE ARUN KUMAR ORAL ORDER 22-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Gopalpur (Rangra OP) P.S.Case No. 295 of 2017 registered under Sections 302/120B/34 of the Indian penal Code and Section 27 of the Arms Act.
Allegation in brief is that in the evening at a Tea Stall, all four accused persons including the petitioner came started abusing the informant's son and opened indiscriminate firing at him causing his death instantaneously.
Submission is that there was land dispute with one Brajesh Yadav, another accused, and there is general and omnibus allegation against the petitioner and only interested witnesses have supported the case.
Whereas learned counsel for the State submits that there is

No.15855 of 2018 (2) dt.22-03-2018 2/2 specific allegation against all four accused persons including the petitioner that they opened indiscriminate firing and several bullet injuries were found on the person of the deceased. Having considered the aforesaid facts and circumstances and the nature of offence, the prayer of bail of the petitioner is rejected.
