Petitioners, already in custody, seek bail in Mansi P.S. Case No.67 of 2017 registered under Section 30(A) of Bihar Prohibition of Excise Act, 2016.

Allegation in brief is that petitioner no.1 was found carrying 35 bottles of foreign liquor each containing 180 ml and 33 bottles of foreign liquor each containing 180 ml was found from possession of petitioner no.2.

Learned counsel appearing on behalf of the petitioner submits that the recovery was made from the bus not from possession of the petitioners and have been in custody since

Having considered the said facts and circumstances, the petitioners, namely, Rockey Kumar and Harendra Kumar are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 3rd, Khagaria in connection with Mansi P.S.
