Heard learned counsel for the parties.
Petitioners apprehend arrest in a case registered for the offences punishable under Sections 366A and other allied sections of the Indian Penal Code.
It is alleged by the informant that his 14 years old sister had gone for defecation. In the meantime, accused Lalbabu Yadav and petitioner no.1 forcibly took her away on motorcycle. On alarm raised by her, when he reached on the spot, he saw said Lalbabu Yadav and petitioner no.1 were fleeing away with his sister on the motorcycle, whereas petitioners no.2 and 3 were running from the spot. Learned counsel appearing for the petitioners submits that the petitioners have falsely been implicated in this case due to dirty village politics. It is further submitted that the matter is of love affair between Lalbabu Yadav and the victim. Learned counsel for the State opposes the prayer for bail. Patna High Court CR. MISC. No.11421 of 2020(2) dt.25-06-2020 2/2 submits that the victim is traceless till date. In view of the nature of allegation, prayer for bail of the petitioners is refused with direction to surrender and seek regular bail which would be considered on its own merit without prejudice.
