JUSTICE ARUN KUMAR ORAL ORDER 15-06-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner, already in custody, seeks bail in connection with Bansi P.S. Case No.13 of 2017, registered under Sections 272 and 273 of the Indian Penal Code as well as Section 30(A) of the Bihar Excise Prohibition Act, 2016. Allegation in brief is that police found the accused persons at the bank of the river Punpun behind the bush engaged in preparing Mahua liquor.

Learned counsel for the petitioner submits that the allegation of preparing liquor is false. It is alleged that 15 litres of Mahua liquor was found in a blue coloured plastic jar but seizure list does not show any apparatus being used in preparing country made liquor, even compliance of Section 100 Cr.P.C. has not been

Having considered the said facts and circumstances, petitioner, namely, Ranvijay Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Arwal in connection with Bansi P.S. Case No.13 of 2017.
