Heard the parties.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

Liquor was recovered from the motorcycle of the petitioner.

Considering the nature of allegation, presumption of law under Section 32 and consequent bar of prayer for anticipatory bail under Section 76(2) of the Bihar Prohibition and Excise Act, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Bettiah Muffasil P.S. Case No. 799 of 2020.
