The petitioners apprehend their arrest in Rosera P.S. Case No.253 of 2019, registered for the offences punishable under Sections 307, 323, 341, 379, 448, 504, 506 and 34 of the Indian Penal Code.
The allegation against the petitioners is that the petitioners forcibly entered into the house of the informant and started assaulting the husband of the informant with lathi, danda and rod. Petitioner no.1 assaulted the husband of the informant with iron rod. Satish Paswan, petitioner no.3 stabbed her
Patna High Court CR. MISC. No.13269 of 2020(4) dt.23-11-2021 2/3 husband. The petitioners also assaulted the informant and her son, Adarsh Kumar. It is also alleged that the petitioners also snatched her chain made of gold from her neck and Rs.50,000/- and fled away.
After some arguments, learned counsel for the petitioners prays that he may be permitted to withdraw this anticipatory bail application so far as petitioners no.1 and 3 are concerned.
Prayer is allowed.
The anticipatory bail application, so far as petitioners no.1 and 3 are concerned, is dismissed as withdrawn with a direction to petitioners no.1 and 3 to surrender before the learned court below within a period of four weeks from today and the learned court below shall consider the prayer for regular bail of petitioners no.1 and 3 preferably on the same day without being prejudiced from the order of this Court. So far as the case of petitioner no.2 is concerned, there is no direct allegation of assault against him. Having considered the fact that there is no direct allegation of assault against petitioner no.2, let petitioner no.2, above named, be enlarged on bail in the event of his arrest or surrender before the learned court below within a period of four
