JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-02-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Gopalganj Town P.S. Case No. 431 of 2012 registered under Sections-420, 406, 467, 468, 471, 464 & 472 of the Indian Penal Code.

The petitioner was Branch Manager of the concerned bank at the relevant time and it is alleged that the informant got opened three fixed deposit accounts in the bank of the petitioner but subsequently, when he made attempt to withdraw his amount, it was found that forged fixed deposit receipts had been given to him.

No.7566 of 2015 (2) dt.27-02-2015 2/2 Learned counsel for the petitioner submits that in the internal inquiry of the concerned bank, it was found that one Sri Bindhyachal Yadav who was working as peon/guard of the concerned branch, had committed the aforesaid fraud and the aforesaid fact is corroborated by the statement of informant, who stated before the Inquiry Officer of the concerned bank that he had given money to aforesaid Bindhyachal Yadav and later on, Bindhyachal Yadav had given fixed deposit receipts to him, which is evident from perusal of Annexure-3 to this petition.

Considering the above-said facts and circumstances as well as submission of the parties, the petitioner named-above, in the event of arrest or surrender in the court below within four weeks from today, shall be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Gopalganj Town P.S. Case No. 431 of 2012 to the satisfaction of Chief Judicial Magistrate, Gopalganj subject to conditions as laid down u/S 438(2) of the Cr. P.C.
