Petitioner, already in custody, seeks bail in connection with Amba P.S. Case No.140 of 2017, registered under Sections 25(1-b)a, 26 of the Arms Act.

Allegation in brief is that one country made pistol with one live cartridge were recovered from possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case, there is no independent seizure list witness, the seizure list witnesses are the police personnel, the petitioner has clean antecedent and he is in custody since 26.10.2017.

Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.18546 of 2018(2) dt.02-04-2018 2/2 petitioner Suraj Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Amba P.S. Case No.140 of 2017.
