The petitioner seeks bail in anticipation of his arrest in connection with Khusrupur P.S. Case No. 165/2020 instituted for the offences under Sections 147, 148, 149, 302, 120(B) of the Indian Penal Code.
The petitioner and eight others are said to have resorted to firing as a result of which, the father of the informant has died.
The learned counsel for the petitioner has submitted that there is a reason for falsely implicating the petitioner. Even otherwise, the accusation against the petitioner is absolutely general and omnibus and it cannot be ascertained from the accusation made in the F.I.R. that the petitioner was the author
Patna High Court CR. MISC. No.36604 of 2021(4) dt.21-04-2022 2/2 of the fatal injury. It has also been submitted on behalf of the petitioner that the informant is not an eye-witness to the occurrence.
Be that as it may, in view of the specific accusation in the F.I.R. of the petitioner and eight others of having resorted to firing which has resulted in loss of life of the father of the informant, I am not inclined to grant anticipatory bail to him. The prayer for anticipatory bail is, therefore, rejected. However, if the petitioner surrenders before the court below and seeks bail, his application shall be considered on its own merits without being prejudiced by the fact that the present petition on his behalf has not been entertained.
