The petitioner apprehends his arrest in Ghorasahan P.S. Case No. 24 of 2021, registered for the offences punishable under Sections 341, 323, 353, 504 and 506/34 of the Indian Penal Code.
As per the prosecution case, petitioner being commercial consumer is not depositing electric bill for the last two months and on 16.01.2021 when the staff of electricity department went at the house of petitioner to disconnect his electricity supply, this petitioner along with others started abusing and assaulting the staff and forcibly connected the electric supply and thus, caused obstruction in the discharge of
Patna High Court CR. MISC. No.13662 of 2022(2) dt.22-08-2022 2/2 official duty.
It is submitted that petitioner has been falsely implicated in this case. As a matter of fact, petitioner has already deposited the electricity bill on 17.01.2021 through online mode before the due date that is 22.01.2021 and there was no occasion to commit such offence. Petitioner claims clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sikrahna at Dhaka, East Champaran in connection with Ghorasahan P.S. Case No. 24 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
