The petitioner seeks bail in Amba P.S. Case No. 46 of 2017, registered under Section 30(K) of Bihar Excise Amendment Act, 2016 As per the prosecution case, 62 litres illicit country made liquor was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that nothing has been recovered from the possession of the petitioner. It is further submitted that petitioner is handicapped by 50% so he neither can drive the motorcycle nor can hold the heavy bag. The petitioner has been languishing in custody since 25.04.2017.

No.28849 of 2017 (2) dt.03-07-2017 2/2 Considering the facts aforesaid, the above named petitioner is directed to enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Cum Additional Sessions Judge-II, Aurangabad in connection with Amba P.S. Case No. 46 of 2017.
