The petitioners apprehend their arrest in connection with Sherghati (Dobhi) P.S. Case No. 861 of 2021 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Petitioners have criminal antecedents. Recovery of illicit liquor has been made from the motor-cycle and the petitioners have been named in the self-inculpatory confessional statement of co-accused, namely, Dipu Kumar.

No.14463 of 2022(2) dt.08-04-2022 2/2 In view of the allegations levelled against the petitioners, this anticipatory bail application is not maintainable in view of the judgment of the Full Bench of this Court in the case of Ram Binay Yadav Vs. The State of Bihar reported in [2019 (2) PLJR 1089 (Full Bench)]. Accordingly, it is dismissed as not maintainable.
