JUSTICE ARUN KUMAR ORAL ORDER 24-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 304(B),201/34 of the Indian Penal Code. The allegation against the petitioner is that he was married with the niece of the informant on 01.05.2015 in a temple. Thereafter the accused persons including the petitioner demanded dowry and started to torture her. On 28.1.12015 the petitioner came to the house of the informant but he did not disclose anything. When he became ready to go to his village then he disclosed that his wife is missing from the house. The informant came to the village and enquired and learnt that her niece had drowned in Ganga river.

Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.29609 of 2017 (4) dt.24-07-2017 2/2 submits that the petitioner's wife was mentally ill and she was being treated by the doctor and she escaped from the house in night. Thereafter the petitioner in the very next morning went to village of informant and informed him that his wife is missing and this case is lodged after lapse of more than one month and ten days.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st Vaishali at Hajipur in connection with Juravanpur P.S.Case No. 02/2016.
