The petitioner seeks bail in Nawadah P.S. Case No. 107 of 2017 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, 300 litres of country made liquor is said to have been recovered from the godown of the petitioner and for that the petitioner was apprehended. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence and has been falsely implicated in this case. The said godown does not belong to the petitioner rather to Chandrika
Patna High Court Cr.Misc. No.18892 of 2017 (3) dt.15-06-2017 2/2 Prasad to whom he had rented out the same on 30.01.2016 i.e. earlier to the occurrence. The petitioner is languishing in custody since 22.02.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawadah in connection with Nawadah P.S. Case No. 107 of 2017.
