JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 15-06-2017 Heard Sri Sanjay Kumar, learned counsel for the petitioner and Sri Atul Chandra, learned A.P.P. for the State. The petitioner in the present case is seeking regular bail in connection with Sadar P.S. Case No. 156 of 2017 for offence registered under Sections 414 and 401 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case and no incriminating article has been recovered from his possession. He further submits that the motorcycle, in question, has been seized from the gate of Bhama Sah and so far mobile and SIM card is concerned, the same was allotted in favour of the petitioner. The petitioner has clean antecedent and he is a student of BSc and has got a character certificate bearing good remarks by Superintendent of Police. Learned A.P.P. opposed the prayer for bail.
However, considering the facts and circumstances of the case and the fact that petitioner has got clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in connection with Sadar P.S.
