JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-03-2015 Heard learned counsel for the petitioner as well as learned Special Public Prosecutor for the State. There is specific allegation of attempting to commit rape against the petitioner and the case has been registered under the provisions of S.C./S.T. (Prevention of Atrocities) Act as well as Indian Penal Code. Therefore, in my view, this petition is not maintainable and accordingly, this petition stands dismissed being not maintainable.

However, if petitioner surrenders before the court below in connection with Runnisaidpur P.S. Case No. 422 of 2014 within six weeks from today and seeks regular bail, the regular

Patna High Court Cr.Misc. No.7535 of 2015 (2) dt.02-03-2015 bail application of the petitioner shall be considered by the concerned court on its own merit without being prejudiced by this rejection order.
