Petitioner seeks regular bail in connection with Bariyarpur P.S. Case No.75 of 2013 registered for the alleged offences under Sections 147, 148, 149, 447 and 302 of the Indian Penal Code and Section 27 of the Arms Act.
As per the prosecution case, the husband of the informant was gunned down by the petitioner at her door. It has been submitted by learned counsel for the petitioner that the petitioner is an innocent and has committed no offence. He has been falsely implicated in this case. The allegations levelled against the petitioner are general and omnibus in nature. It is also submitted that the petitioner has been named in this case due to grudge.
Patna High Court Cr.Misc. No.29399 of 2017 (02) dt.01-07-2017 2/2 Considering the nature of allegation and also the past antecedent of the petitioner, I am not inclined to enlarge the petitioner on bail. However, the learned Court below is directed to conclude the trial expeditiously, preferably within a period of six months from the date of production/receipt of a copy of this order. If the trial is not concluded within the period of six months, the petitioner may renew his prayer for bail.
Accordingly, this application is rejected.
