Learned counsel appearing on behalf of the appellant seeks permission to withdraw the present appeal, which is against acquittal, as to file the same before Hon'ble Division Bench of this Court, for the reason that respondent nos. 2 to 6 have been acquitted from the charges levelled against them under Section 307 of I.P.C., for which
Patna High Court CR. APP (SJ) No.782 of 2020(3) dt.31-07-2024 2/2 sentence may go upto life imprisonment.

Accordingly, the present appeal stands disposed of as withdrawn with direction to the office that the certified copy of impugned judgment and Vakalatnama be returned in original to the learned counsel appearing for the appellant, as to enable him to file the appeal before Hon'ble Division Bench of this Court, as aforesaid.
