This is an application for grant of anticipatory bail in connection with Goreakothi P.S. Case No. 184 of 2014 registered for the offence punishable under Section 379 of the Indian Penal Code.

The case of the prosecution is that one motorcycle was stolen by unknown person and when the said motorcycle was recovered from the house of the co-accused, the said co-accused named the petitioner as one of his accomplice. The learned counsel for the petitioner submits that the said person from whose house the motor-cycle was recovered, has already been granted bail. It is further submitted that two cases are pending against the petitioner, however, the petitioner is on

Patna High Court Cr.Misc. No.8403 of 2018(3) dt.03-04-2018 2/2 bail in the said cases.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-11, Siwan in connection with Goreakothi P.S. Case No.184 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. It is further directed that the petitioner would mark his attendance before the Officer-in-Charge of the concerned police station at 10:00 am. on each Monday of the week and in the event of two consecutive defaults, the present privilege of the anticipatory bail shall stand cancelled automatically.
