The petitioner has renewed his prayer for grant of regular bail in a case registered under sections 302, 328 and 34 of the Indian Penal Code.

As per the prosecution case, the allegation against the petitioner who happens to be the husband of the deceased is of having beaten up and poisoned the daughter of the informant to death.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide orders dated 3.1.2021(Annexure-1). Relying on the deposition of the prosecution witnesses brought on record as Annexure-3 to the petition it is submitted that the informant has not supported the prosecution case. Court being vacant, there is no chance of the trial concluding in the near future. The petitioner is in custody since 13.1.2020 and undertakes to cooperate in the trial.

Having heard learned counsel for the parties and on going through the deposition of the witnesses, the Court finds that the witnesses have supported the prosecution case. Further as per the report received contained in letter dated 11.4.2022 of the I/c District and Sessions Judge, four witnesses on behalf of the prosecution have been examined and three public witnesses including two Investigating Officers and a private witness Santosh Kumar remain to be examined. The trial is expected to conclude within six months. Having heard learned counsel for the parties and taking into consideration the nature of allegation together with the progress in the trial in the learned trial court, the Court is not inclined to enlarge the petitioner on bail and the application is rejected. Learned trial court is directed to conclude the trial within six months from the date of communication of this order. (Partha Sarthy, J) Spd/- U T
